Our agreement is to throw you a Pony Party with hand led ponies. Your agreement is to
have fun, and to create those special memories that will last a lifetime!!!!!
We have a few rules that must be acknowledged, agreed upon, and signed before we can accept
your deposit and reservation.

to hold your date and time: For Larger Parties over the dollar amount of $325.00 a $100.00 deposit is required.

paid either via check. Cash. Venmo Cash app, for credit card transactions are accepted at an additional 3% processing fee.

Terms
Weather is always a concern, we reserve the right
and also give you the Client the right to cancel or reschedule if the weather is foul (meaning continuous rain, hail, sleet,
snow, or hurricane type winds) (this also includes levels of extreme heat, or cold as measured by the real feel,
and may include wind chill effects and humidity effects.) we want our ponies and your children to be happy not miserable:
BAD WEATHER POLICY: If it is raining on the day of your event, you
will need to contact us to cancel 2 hours prior to the start of your event. If it is raining/or there is
a forecast for rain and you tell us to come and THEN cancel after we have arrived at your event, the deposit is
non refundable and the balance of your party is due in full. Should you contact us and request to cancel, due to rain/or
the forecast of rain, and it does not rain at the time of your event, your deposit is non-refundable. Refunds
are not offered for any other reasons, other than weather.
Cancellation Policy: We
only issue deposit refunds based upon weather. Cancellations of any other nature the Deposit received is unrefundable.
Pony Parties
can be performed almost anywhere, such as backyards, front-yards. However, our ponies cannot perform on rocks, uneven or un-level
ground, HILLS, ROADS, CONCRETE Drives or grass that has been treated with pesticides or fertilizers with 7 days of the party
date. Location cannot be on a major/busy highway, or front yard, which receives large amounts of street
traffic. The area in which you would like to hold your pony party needs to be an area large enough for the ponies,
and your children, thus meaning we need additional room from the area we are working in, to allow your quests to wait
,(out of harms way). This is strictly for the safety of our ponies, our staff and your children.
We must have adequate parking close
to the party location for our Truck and Trailer to park and unload the ponies safely: We can not unload our ponies on a busy
highway, parking lot, hill or road which receives large amounts of street traffic. ***Kindly advise if your street is a narrow
street, with no or limited parking, or your street goes to a dead with no cul de sac for which we can turn around in.
Please
plan the location for where you would like the ponies to work appropriately. We have the right to stop, cancel, and or remove
our ponies from any unsafe conditions. For example, the following conditions are not meet. Fireworks, loose or barking
dogs, lighting and thunderstorms, children on bicycles, scooters, roller blades etc. Children playing football, soccer, baseball
or Frisbee near or around, where our ponies need to perform. Water guns, games with loud noises, clacking or banging. Bouncies,
trampolines, swing-sets and water-slides, need to be placed out of the path in which you would like for us to work. Please
have children re-frame from using these items while our ponies are in use. If we determine the area in which you would like for
the pony(ies) to perform, is unsafe for the children and ponies alike, we have the right cancel, stop and or remove
our ponies from any unsafe conditions.
Kindly review " A word from our Ponies" with your guests prior
to our arrival. The children and your guests will be asked to follow these simple rules for their safety, ours, and our ponies.
You may wish to print a copy, and include along with your party invites.
Children should be between the ages of
2- 12. The max weight our small pony can carry is 50 lbs: our larger pony is 110 lbs. ( We can not make any exceptions, please
be aware of the size of your guests and size of pony you wish to attend your party.)
Lastly, we cannot be held
responsible or liable for any property or landscaping damage associated with pony hoof marks, grass nibbling, and or droppings
(which will be our responsible to promptly remove) . We will do our best to leave your home exactly the way we found it:_______________

Under
North Carolina Law, an equine activity sponsor or equine professional is not liable for injury to or the death of a participant
in equine activities resulting exclusively from the inherent risks of equine activities.(Chapter 99E of the North Carolina
Statues) (Article 7, Chapter 9 of Title 47, Code of Laws of South Carolina), (see links page for more in formation on
this Statue). I understand that: Horseback riding is classified as RUGGED ADVENTURE RECREATIONAL SPORT ACTIVITY, and there
are numerous obvious and non-obvious inherent risks always present in such activity despite all safety precautions. I understand
the nature of the Horse/Pony, and understand that Janet Menetrier chooses its horses and ponies for their calm dispositions
and sound basics training, and that Janet Menetrier follows a rigid safety program. Yet, no riding horse/pony is a completely
safe horse/ pony. Horses and ponies are 5 - 15 times larger, 20 - 40 times more powerful, and 3 -4 times faster than a human.
Should a rider fall from a horse or pony it will generally be a distance of 3.5 - 5.5 feet, and the impact may result
in injury to the rider. Horseback riding is the only sport where one much smaller, weaker predator animal (human) tries to
impose its will on, and become one unit of movement with, another much larger, stronger prey animal with a mind of its own
(horse/pony) and each has a limited understanding of the other. If a horse/pony should be frightened or provoked it may divert
from its training and act according to its natural survival instincts which may include, but are not limited to: Stopping
short, changing direction or speed at will, Shifting its weight, Bucking, Rearing, Kicking, Biting, or Running from danger.
Property owner to obtain insurance for the above services requested. Property owner, Client providing the activity their heirs
and guests, assume all risks involved in or arising from the use of the services provided by, Janet Menetrier and all of its
successors, assigns, subsidiaries, affiliates, officers, directors and heirs completely harmless and not liable and release
them from all liability whatsoever and agree not to sue them on account of or in connection with any claims, including without
limitation, those based on death, bodily injury, property damages, and any consequential damages. Should any clause
be in conflict with the State Law, then that clause is null and void.
To
make a Deposit or Payment on line:

the Party Agreement, you may either mail or email your Agreement. (We must receive your Party Agreement prior to
the day of your pary, regardless if you made an on line payment or mail payment. No, exceptions are made.)
• Select
payment amount.
•Complete the additional information box, when submitting your payment, with:
Your name, address and date and time of your party.
•Email janet@ponypartiescharlottenc.com with your payment confirmation number. (you may include this along with your completed party agreement)
•Please
note, weather related deposit refunds, made with an on line payment are subject to a $5.00 handling fee.(ex.If you made
an online payment of $50.00, and your party is canceled due to the weather, you will receive a $45.00 refund deposit back)
•If
you would like to pay your party balance by credit card payment. We now are accepting major credit cards. Credit
Card Payments maybe made online through the PayPal link below, or at the time of your party.
